What is a real estate transaction?

Real estate transactions are when a seller sells their property and a buyer accepts the offer. There are many steps involved in purchasing a home, and they vary depending on what type of transaction you’re making and state regulations. Every real estate contract has three main sections:

  • Making an offer on a property is the first step.
  • Negotiation, acceptance or rejection of the offer.
  • Closing the transaction.

These tasks are, in the first instance, the responsibility of real estate agents. The buyer and the seller are also responsible for completing tasks.

What is the Closing Process?

It may seem simple to close the transaction. Before the seller can transfer the title of the property to the buyer, he must complete a number of tasks and activities on time. It’s important to meet all of the regulatory requirements.

The following tasks are included:

  1. Home inspections are important.
  2. Search for titles.
  3. Insurance is a good investment.
  4. Putting property purchase funds into escrow.
  5. The property is inspected in its entirety.

The correct paperwork and documents must be filed at the appropriate time. The deal may fall through if you fail to do so.

Who are the parties involved in a real estate transaction?

Following people are involved in the successful completion of a real estate deal, including:

  • Real estate broker.
  • Real estate agent.
  • Seller.
  • Buyer.
  • Mortgage Lender
  • Home inspector
  • Search for a company or attorney by title.

What is the role of each party in a real estate transaction?

Each person involved in a real estate transaction has responsibilities:

Real estate agent or broker

During real estate transactions, the real estate agent or broker usually works for either buyer or seller. Sometimes, an agent will work both for the buyer and seller in the same transaction. Both the seller and the buyer will have an agent who will guide them through the process of transferring the property.

The transaction coordinator

They keep the deal moving by supporting the broker or agent. They handle the administrative aspects of real estate transactions from the contract to the closing. The following tasks are included:

  • Coordination of property inspections
  • Manage escrows, mortgage loans and appraisals.
  • Ensure that all documents are submitted.
  • Keep everyone informed of progress.
  • All necessary regulations must be met.
  • Ensure that files are stored securely.

The seller

The seller agrees in writing to list their house for sale through a realty agent. The seller authorizes the agent to promote their home in order to attract buyers and negotiate an acceptable home sale.

The buyer

Buyers usually partner with agents who are able to propose an exclusive agreement, called a buyer-broker contract. This agreement promises that the buyer will only work with this agent. They help buyers negotiate the purchase of a home and prepare the offer to purchase when they find the perfect house.

Mortgage lenders

Mortgage lenders help buyers fill out the necessary paperwork to obtain a mortgage and are able to get approval. Before visiting any real estate agents, clients should first visit a lender. The lender will determine the amount the buyer is financially qualified to borrow, and provide a letter of “pre-qualification”.

Home inspectors

When buying a house, a home inspection company is essential. They ensure that the home is in good shape and meets the requirements of the state or county.

The Title Company or Lawyer

In some states, title companies can handle the paperwork for both the buyer and the seller. Others require that an attorney closes the sale. Bonardi & Uzdavinis’ most important function is to perform a thorough search of the title to make sure that the property is in good standing and is ready to be transferred to a new owner. We confirm that the seller is legally the owner of the property and can transfer the title. We issue a title policy after completing the process to ensure that all parties are protected.

What are the steps in a real estate transaction?

Following is a list of the steps in an orderly real estate transaction:

1. Search for a property or list your home for sale

A selling agent will make a property for sale by listing it on a Multiple Listing Service (MLS) and locating a buyer. A pre-qualification letter should be in the buyer’s possession from the lender, stating what amount of money they are able to borrow for a home purchase. The down payment of the buyer should be already in the bank.

2. Offers

The real estate agent of the buyer prepares a sale purchase agreement that specifies price, terms and deadlines. The seller sets a price, which is also called the “listing” price. This price may be negotiable. It might not match the final price that the buyer pays.

3. Negotiation

The seller may review the offer, and then counteroffer the price and conditions they prefer. A seller can only deal with one buyer. There may be several offers for the house, but the seller will select the one that is most beneficial to them. This forces the other buyers back to the market. The price that was agreed to after the negotiations is called “the purchase price”. The “effective date” of the contract is the date that both parties agreed on after the final counteroffer.

4. How to choose a lawyer or title company

Buyers and sellers can choose their title company, or they can retain separate representation. The buyer makes an initial deposit (often called “earnest cash”) and gives it directly to the title company. They hold it in an escrow account that does not pay interest until closing. This money is held by the escrow agent, who must make sure it’s available at the closing of the real estate transaction.

5. Appraisal and inspections of vehicles, as well as repairs

The mortgage company will then determine if the house is worth what the buyer wants. It sends an appraiser from a third party to compare the price of the house to similar properties in the neighborhood. The appraiser gives the seller a list with recommended repairs. Both the buyer’s and seller’s agents negotiate to determine what repairs the seller will make. The buyer may rescind an offer if the seller refuses to make the repairs or credit the buyer for the closing costs. The whole process starts over if this occurs.

6. Contingency removal

A contingency date is a time when the buyer must have secured funds and released the financing. Every home inspection has an alternative date. They require that everything be negotiated by a certain time. In order to finalize a transaction, the agreed-upon repair work must be completed and receipts must be issued for the work.

7. Closing

Closing is an essential step in any real estate transaction. It is therefore important to keep track and understand the process. Closing involves:

  • Proof of insurance is required by the mortgage company before closing. A real estate agent should be able to advise the buyer on the type of homeowner’s policy they need and the best places to find it.
  • Mortgage conditions: Before the mortgage company gives the “clear-to-close” they will provide a list with items that the buyer must complete.
  • Prepare to move: Inform buyers of the upcoming moving date and remind them to start packing and hire movers.
  • Title company should have sent you the disclosure prior to closing. The disclosure will include all closing costs related to the purchase of the home. The buyer must send the full amount due to the title company in order to close the sale.
  • The agent will accompany the buyer to the home for a final walk-through before the closing. The walk-through will verify that all repairs have been completed and that the house is in the same state as during the offer period.
  • Title search: A title company will perform a title search to make sure that the owner is legally entitled to sell the property, and that there are no defects in the title that could delay the closing.
  • Preparation of real estate closing documents: Title companies or lawyers prepare the closing documents, which are signed by both the buyer and the seller. This facilitates the transfer of property.
  • The mortgage company will issue a “clear to close” or “clear to close”. This signifies that the mortgage process has been completed by the buyer and the funds have been transferred to the seller. A notary must be present for the signing of the documents by the buyer and the seller.
  • Close the deal: The closing takes place in the office of an attorney or title company. There is a lot to sign if the buyer has a mortgage.
  • The buyer will receive the keys after everything has been signed and the title firm has received the funds from the mortgage company. This is the official transfer of ownership. The title company will update the public records with the new owner.

8. Commission

The selling agent will receive a gross commission once the real estate transaction is closed. Usually, this is around 6%. This money is usually split evenly between the brokerages that handle buying and selling. The company’s commission structure will determine the distribution of commissions between the broker, the agent and the other members of the team.

What Are the Regulatory Requirements for a Real Estate Transaction?

Many state and federal guidelines must be followed during real estate transactions. Agents on both sides of a real estate deal must adhere to government procedures that protect buyers and sellers. In most states, agents have a fiduciary duty to their clients—whether they’re the buyer or the seller. Along with loyalty, full disclosure, obedience, due diligence, and accounting, the agent is also responsible for maintaining the client’s confidentiality. In states where agents act as transaction brokers, they owe all the duties except confidentiality and may work for either the buyer, the seller, or both in the same transaction. Real estate brokers, in turn, are responsible for their agents’ actions and behavior throughout the transaction. Real estate compliance exists at the local, state, and federal levels, ensuring that buyers and sellers are protected by holding brokers accountable for their fiduciary duties.
